El fundamento ético democrático del derecho en las Leyes de Platón

Resumen
En este artículo nos proponemos ofrecer una lectura diferente de la lectura tradicional de la teoría política de Platón que sostiene que la política y el derecho encuentran su fundamento en el conocimiento del filósofo rey. Para esto, tomamos las Leyes que, según nuestra mirada, brinda una teoría política que desafía esta interpretación tradicional. Acorde a nuestra visión, en esta obra Platón establece que el derecho y el régimen político encuentran su fundamento en el dógma póleos koinón (I 644d1-4) o la opinión pública. Así, de la lectura de las Leyes, podemos establecer que: el derecho es conceptualizado como dógma o un sistema de creencias comunitarias, el dógma es expresión de prácticas y opiniones sociales y, por lo tanto, concluir que el dógma funda el derecho en la convención del pueblo. El derecho, entonces, tiene un fundamento ascendente proveniente del pueblo que es el que le otorga legitimidad a partir de la aceptación y discusión pública del régimen jurídico.
